Claim Presence Policy
This Policy is incorporated into and forms part of the Nusu Terms and Conditions. Capitalized terms not defined here have the meaning given in the Terms.
- Authority to represent: I am the owner, employee, or authorized agent of this business and have the right to manage its Nusu Presence.
- Identity verification: I consent to Nusu's verification process (e.g., phone call, email at the business domain, mailed code, document upload) and will provide accurate information to complete it.
- Accurate information: All business details I provide or update (name, address, hours, services, contact info, etc.) are truthful, current, and not misleading.
- No impersonation or fraudulent claims: I will not claim a business I do not represent, claim a competitor's Presence, or use a Nusu Presence to mislead consumers about who they're dealing with.
- One legitimate claim: I understand that only one verified owner/primary manager is permitted per Nusu Presence, and false claims may result in permanent removal.
- Review integrity: I will not post, solicit, incentivize, or pay for fake or biased reviews, will not review my own business, and will not pressure customers to remove negative reviews.
- Professional conduct in responses: I will not harass, threaten, retaliate against, or publicly disclose private information about reviewers or customers.
- Compliance with law: I will comply with all applicable laws, including consumer protection, advertising, FTC endorsement guidelines, and privacy regulations (GDPR/CCPA where relevant).
- Rights to content: I represent and warrant that I own or have the necessary licenses, consents, and permissions for all names, logos, trademarks, photographs, and other materials I submit, including any depicted persons' likenesses, and that Nusu's use as licensed below will not infringe any third-party right.
- Content license: I grant Nusu a worldwide, non-exclusive, royalty-free, fully-paid, sublicensable, transferable license to host, store, reproduce, modify, adapt, translate, create derivative works of, publicly display, publicly perform, and distribute the content I submit, in any media now known or later developed, for the purpose of operating, promoting, and improving the Services. The license survives termination to the extent necessary for backups, legal compliance, and content already distributed before revocation.
- Customer data handling: Any customer information I access through Nusu will be used only for legitimate business purposes and protected per applicable privacy law.
- Notification of changes: I will promptly update my Presence or notify Nusu if the business closes, is sold, or I no longer have authority to manage it.
- Nusu's discretion: I acknowledge Nusu may suspend, revoke, or transfer the claim at its discretion, particularly in disputes over ownership.
- Indemnification: I will defend, indemnify, and hold harmless Nusu Inc., its affiliates, and their officers, employees, and agents from and against any third-party claims, damages, liabilities, costs, and reasonable attorneys' fees arising out of or relating to (a) my Presence content or conduct, (b) my breach of this Policy or the Terms, (c) my violation of any law or third-party right (including IP, publicity, and privacy rights), or (d) any dispute over authority to claim or manage the Presence. Nusu may assume exclusive defense and control of any matter subject to indemnification, at my expense.
- Updates to terms: I understand these terms may be updated, and continued use of my Nusu Presence constitutes acceptance.
